Te Tiriti duplicity: honoured abroad but dismissed at home

“The government is aggressively utilising Te Tiriti to secure elite global market access, while actively dismantling the domestic legal architecture that is required to give the text any real meaning,” writes Nicola Hoobin about NZ trade agreements such as the one signed with India this year. (Photo: RNZ Marika Khabazi) Aotearoa is facing its sharpest constitutional crisis in modern history, as the government professes adherence to Te Tiriti abroad while dismantling it at home, writes international legal practitioner Nicola Hoobin. The coalition government appears to have overlooked a profound legal contradiction as it methodically advances its legislative programme to review, alter, or strip Te Tiriti clauses across 19 separate acts of parliament. While the government is busy dismissing Te Tiriti at home as a flexible, non-binding political instrument that can be unilaterally dismantled by a simple parliamentary majority, it seems to have forgotten that in international trade agreements, it continues to treat the document as a rigid, foundational constitutional pillar. In other words, the government is attempting to maintain an impossible double standard. The smoking gun of this constitutional duplicity sits directly within New Zealand’s premier international trade instruments. These are Article 20.2.1 of the European Union-New Zealand Free Trade Agreement (signed in July 2023) and Article 26.2.1 of the United Kingdom-New Zealand Free Trade Agreement (signed in February 2022). To secure unprecedented market access to the European single market and post-Brexit Britain, the Crown formally executed binding international texts. In doing so, it explicitly, deliberately, and repeatedly assured our global trading partners that: “te Tiriti o Waitangi / the Treaty of Waitangi is a foundational document of constitutional importance to Aotearoa New Zealand.” Far more than empty diplomatic prose, this is an enacted, state-sanctioned admission within international treaties. Under international law, the doctrine of pacta sunt servanda (agreements must be kept) dictates that treaties must be performed in good faith. The Crown can’t, in good faith, represent Te Tiriti to the international community as a permanent document of “constitutional importance” to secure lucrative market access, and then turn around domestically to claim it has a democratic mandate to systematically strip that very same constitutional fabric from our statutory architecture. In public international law, this triggers a principle akin to “estoppel”, which means that a sovereign state can’t blow hot and cold on its foundational legal obligations to suit its immediate economic or political convenience. Te Tiriti in trade agreements The EU and UK agreements represent a radical, modern departure in New Zealand’s trade agreement architecture. In these two agreements, the Crown has shifted from using the Treaty as a passive domestic shield to using it as an active diplomatic marketing asset. Compare the language of “constitutional importance”, for example, with New Zealand’s foundational 1983 Closer Economic Relations agreement with Australia, which contains absolutely no mention of Te Tiriti o Waitangi. By explicitly elevating Te Tiriti to a “foundational document of constitutional importance” in modern texts to secure premium global market access, the executive drew a clear, contemporary line in the sand — one that it can’t now legally or logically erase. Potential for diplomatic friction The legal mechanics of how these international commitments interact with dispute resolution are also revealing. In the UK-NZ FTA, Chapter 26, which relates to Māori trade and economic cooperation, is explicitly carved out from the agreement’s formal, binding state-to-state dispute settlement mechanism. This structural separation means that a failure to cooperate under the terms of the Māori trade chapter can’t trigger formal international trade sanctions or panel arbitrations. By contrast, the EU-NZ FTA approaches compliance through a highly tailored, progressive framework. While the broader interpretation of the Treaty of Waitangi itself remains shielded from standard commercial arbitration panels, the commitments embedded within Chapter 20 (Māori Trade and Economic Cooperation) are subject to specialised bilateral consultation mechanisms. The EU agreement establishes a dedicated institutional dialogue where compliance with the spirit of the Indigenous chapter is under continuous review. This creates an active international forum. If domestic rollbacks undermine Māori economic interests, data sovereignty, or environmental guardianship, it invites direct diplomatic friction and specialised dispute-consultation mechanisms with Brussels. Lest anyone think this international double standard is a relic of previous administrations, the government’s actions in New Delhi show the pattern is alive and well. In signing the landmark New Zealand-India Free Trade Agreement in April this year, the current coalition government exported the Treaty yet again, embedding a dedicated “Cultural, Traditional Knowledge and Economic Cooperation Chapter” that requires all actions to be executed in a “manner consistent with the Treaty of Waitangi”. The Crown continues to play a calculated game. Although, once again, the chapter is safely insulated from formal international dispute penalties, the contradiction it presents to domestic strategy creates a fatal blind spot. In New Zealand public law, courts frequently look to international treaties signed by the executive as extrinsic evidence to interpret the scope of the Crown’s fiduciary obligations. So, for example, if iwi launch judicial reviews against the rollbacks of the 19 targeted statutes — which cover critical resource management, biosecurity, and primary industries — the FTA texts become powerful legal levers. The Crown cannot easily look a High Court judge in the eye and argue that statutory Treaty obligations are vague, unworkable, or a threat to democratic certainty when the executive branch has formally executed international documents telling the UK and EU the exact opposite. The explicit acknowledgments in the EU and UK agreements effectively block the Crown from downplaying the constitutional status of Te Tiriti in a domestic courtroom. This inescapable double standard shifts the ultimate burden of accountability from global panels directly onto our domestic judiciary. Will the New Zealand courts now hold the Crown strictly accountable for its own international admissions, enforcing the principle that a sovereign government can’t legally define Te Tiriti as a cornerstone of our constitution to the rest of the world while treating it as entirely disposable at home? Indefensible urgency With a general election approaching in November, the government is operating within a rapidly shrinking legislative window. As constitutional conventions require a shift towards a caretaker government framework in the coming months, the use of urgency motions to fast-track these 19 statutory rollbacks becomes increasingly indefensible. The international community is watching. If the Crown continues to treat its constitutional partnership with Māori as a disposable asset at home, it risks compromising New Zealand’s standing as a trustworthy partner in global trade, diplomacy, and international law. I hope you enjoy it! ::: spoiler summerizer Thesis and definitions Carnivore status is defined by the diet that gives an animal optimal nutrition, not by survival on small amounts of plants. Humans need nutrients found in meat, while no plant or fungal food is necessary when meat is eaten exclusively. RDAs come from mixed-diet conditions, so nutrient needs can change when the diet is exclusively meat. Chronic disease comes from species-inappropriate food: too many plants, not enough animal protein and fat. Biological and anatomical evidence Zoo animals, dogs, and cats get obesity, diabetes, cancer, autoimmune disease, and arthritis when fed foods unlike their wild diets. Human teeth, jaws, brains, stomach acidity, fat-digestion organs, appendix, and colon all point toward animal-based adaptation. Human stomach pH sits near scavenging carnivores, which fits meat with high bacterial load and meat preserved without refrigeration. Five organs work together to digest and absorb fat, which makes animal fat central to human nutrition. Humans cannot break down fiber like herbivores; the appendix is a vestigial cecum, not a fermentation chamber. Fiber, bowel disease, and IBD Fiber is waste material, blocks nutrient absorption, irritates the gut lining, increases mucus and inflammation, and overworks the colon. Diverticulosis tracks with higher fiber intake and more bowel movements, while constipation, fat, and meat do not track with it. Surgeons use low-residue diets after bowel injury because bowel rest helps recovery. Red-meat-and-water diets, elemental diets, and carbohydrate restriction fit the same bowel-rest model for Crohn’s disease and ulcerative colitis. Salisbury, Voegtlin, elemental-diet trials, and fasting-mimicking-diet work support removal of irritating plant material from IBD patients. Evolution, tools, and isotope evidence Humans split from other primates, ate more meat, became taller, grew bigger brains, reduced teeth and jaws, and developed tools and tactics. Early pound stones and later worked tools were used to open skulls, access brains, kill animals, and dismember carcasses. Ice-age conditions pushed surviving ancestors toward animal nutrition because plants and plant-eating animals disappeared under ice sheets. Stable isotope work places early humans, Homo sapiens, and Neanderthals high on the food chain, often above other predators. The Tel Aviv work by Miki Ben-Dor puts humans as hypercarnivorous apex predators across at least 2 million years. After agriculture, skulls, jaws, teeth, height, and brain size worsened because nutrition shifted away from animal foods. Crooked teeth and small jaws come from inadequate nutrition and oral development conditions, not rapid evolution. Pre-agricultural people had wider jaws, straight teeth, wisdom teeth, taller bodies, and larger brains. Brain size rose with meat and fat intake, then dropped when agriculture and plant foods became widespread. Carnivorous human populations Native American buffalo hunters used mass kills, drying, and pemmican to feed communities for long periods. Tall Native American groups, Mongol horse cultures, Inuit groups, Maasai, and Australian Aboriginal hunters are used as human carnivore examples. Mongol armies relied on horse meat, blood, and milk products, traveled without frequent meals, and built a vast land empire without grain agriculture. Inuit accounts include meat eating even during seasonal thaws, with little interest in sour berries. Maasai and Australian Aboriginal groups are tall, lean, muscular, and healthy before Western foods displaced animal foods. Herodotus’ Ethiopian account and Salisbury’s Native American account are used as examples of meat-eating populations linked with long active lives. Metabolic model Fasted metabolism is the normal metabolic mode, and carbohydrate eating interrupts it through insulin. Insulin blocks lipolysis, proteolysis, ketone production, and leptin signaling, so the brain receives a false starvation signal. Carbohydrate-containing diets lower daily energy expenditure by about 300 kilocalories compared with the same calories without carbohydrates. Glucose and fructose damage tissues through glycation, and chronic high blood sugar drives diabetic damage. Ketogenic diets have long been used for diabetes by removing sugar, carbohydrate, and alcohol inputs. Cancer and mitochondrial metabolism Warburg’s cancer model centers on damaged mitochondria, impaired oxidative phosphorylation, glucose dependence, fermentation, and lactate production. Seyfried’s metabolic cancer model builds on Warburg and links cancer control to mitochondrial function and glucose restriction. Ketosis reduces glucose availability to cancer cells and improves mitochondrial respiration, abundance, and resilience in non-cancer cells. Paleomedicina and Cedars-Sinai are used as examples of clinical interest in ketogenic or carnivore-style metabolic therapy for cancer and chronic disease. Plant defenses and natural pesticides Plants cannot run or fight, so they use chemical defenses against insects, animals, and humans. The University of Washington cancer-biology story centers on plant carcinogens and the idea that vegetables contain many natural toxins. Bruce Ames’ work compares naturally occurring plant pesticides with synthetic pesticide residues and finds the natural chemicals far more abundant. Edible plants are handled as less acutely poisonous than hemlock, not as harmless food. Cassava, almonds, cyanogenic plants, peach pits, phytoestrogens, soy, nightshades, gluten, and lectins are used as toxin examples. Hormones, nutrient blockers, photosensitivity, and lectins Soy phytoestrogens are compared with estrogen amounts in women, birth-control pills, and growth-hormone beef. Carbohydrate-driven insulin disrupts leptin and the conversion of testosterone to estrogen, which is tied to PCOS. Fiber, soy, wheat, gluten, and protease inhibitors reduce digestion and absorption of protein and other nutrients. Lime oils and celery compounds are used as examples of plant chemicals that create photosensitivity and sun-related skin injury. Lectins can cross a damaged gut barrier, trigger antibodies, and create molecular mimicry that drives autoimmune disease. Removal of lectins and other plant compounds through a red-meat-and-water carnivore diet is given as reversing Crohn’s disease, ulcerative colitis, rheumatoid arthritis, and Hashimoto’s. Final conclusion Humans are obligate carnivores with one optimal diet: meat. Variation by sex, pregnancy, childhood, or individual preference does not change the species-specific diet. Biology, anatomy, evolution, anthropology, metabolism, plant chemistry, and disease reversal all point to meat as the optimal human food. Plants use defense chemicals because survival in nature is kill or be killed, and human health improves when those chemicals are removed. What else was their success in these endeavors reliant on? Why is it insulting to look at the material conditions of the people and see the correlation? A bunch of proud and devout religious people overcame adversity through their faith. They didn’t overcome anything through faith, they made actual efforts and sacrifices against imperialism. The success of a revolution does not require belief in religion. A large part of the Black liberation movement came out of Christianity that was forced on Black people via their subjugation by Europeans, should they be embarrassed of that or is it just the circumstances they found themselves in while still attempting to better their circumstances? Christianity has been a consistently reactionary force in America for its entire history. Nearly all the racists and homophobes in the US call themselves Christian. Some civil rights leaders being Christian does not mean Christianity was a positive force in black liberation. I don’t understand why a communist should be embarrassed of having a clear and accurate analysis of any given situation. Islam is obviously an intrinsic part of Iran, which is why the leadership hasn’t become like most of the nations around them and succumbed to Israel and US influence. Syria is run by self proclaimed Muslims but they obviously don’t actually prioritize their religion because they are actually pawns of Israel and the US. Saudia Arabia is run by self proclaimed Muslims but they worship money, not Allah, so they are not beholden to the demands of Islam. If Iranian leadership acted like this, there would be a second Islamic revolution in Iran that would put devout Muslims in charge again, because that is the priority of the masses as devout Muslims themselves. What is this nonsense? American allies don’t count as Muslim but Iran does? Iranians would overthrow an unjust Islamic government but Saudis and Syrians apparently cannot? Does religion just not exist when it isn’t anti-imperialist?
